Terms and Conditions

1. Scope

These terms cover the use of xavixai.com and XAVIX AI services and tools. Prices and timelines on the site are indicative; what binds both sides is the written proposal and the signed contract. If the contract differs from this page, the contract applies, and each contract follows the version of these terms it was signed under.

2. Services and tools

• Services: work the XAVIX team does for your project, such as websites, landing pages, search visibility, maintenance, brand identity, content production and ads management.
• Tools: software owned by XAVIX that your team uses on a monthly subscription, with custom implementation on request. Tools marked “in development” are not for sale yet.
• We don't manage social media accounts: posting, replying to messages and community management are the client's responsibility.

3. Pricing and payment

How we price: by actual working hours. We write the code ourselves with modern technology (such as Next.js), we don't use ready-made templates like WordPress, and we keep reviewing until the work is as complete as it can be. You may find lower prices for template-based work; that is a difference in the kind of work, not just the price.

• Every written proposal breaks down the hours of each phase. The base rate is $15 per hour; content production is $25 per hour.
• Clients in Egypt pay in EGP at the National Bank of Egypt rate on the invoice date.
• Quick products: paid upfront, and the price is credited if you upgrade to a larger plan within 3 months.
• Full projects: 50% when the contract and requirements document are signed, 25% one month before the delivery date, and 25% on delivery. The site does not go live on the domain before the final payment. For projects shorter than two months, the second payment is due when the design is approved.
• Monthly plans: 3-month minimum; unused hours don't roll over; extra hours are $15 per hour.
• Monthly subscriptions (tools and plans): paid upfront at the start of each month, and non-refundable 24 hours after payment. If you cancel, service continues until the end of the paid month, then stops, and the next month is not charged. We send a WhatsApp reminder 3 days before renewal. Plans with a minimum term can't be cancelled before it ends.
• Ad budgets are paid by the client directly to Meta and Google with their own card. XAVIX never receives ad money.
• Content production: up to two shoots a month; the client covers the full trip costs (accommodation, transport and program).

4. Scope and revisions

We agree on everything before we start, and what we agree binds both sides. This protects your time and ours, and keeps the project price from growing with requests nobody planned for.

1. Requirements document: before building, we write a document with the client listing pages, sections and features, the content the client provides and when, and the number of review rounds. Both sides sign it, it becomes part of the contract, and work doesn't start before it's signed. Sessions to prepare it are billed at the hourly rate and credited against the project if you go ahead.
2. Only what's written binds: any request not in the requirements document is not part of the project, even if it was mentioned verbally or in an earlier conversation.
3. Review rounds: one for quick products, two for brand identity, and as the document states for full projects. A review round corrects the work to match what was agreed; it is not for adding new items or changing what was already approved.
4. Consolidated feedback from one person: the client names one person authorized to approve, who sends each round's feedback in a single message within 3 working days of receiving the phase. If no feedback arrives in that time, the phase counts as approved.
5. Approved work stays approved: an approved phase (structure, design, content) isn't changed within the project price; changing it later is treated as a change request.
6. Change requests: any new request after the document is signed is submitted in writing, and we reply with the estimated hours and the effect on the delivery date. It's done only after the client approves in writing and pays for it, and we may schedule it after the original scope is delivered so the project isn't delayed.
7. Timelines: stated timelines assume the client delivers content and approvals on time; any delay on the client's side moves delivery by at least the same amount.
8. If the client goes quiet: after 14 days without a reply, the project is paused and rescheduled around our workload when the client returns. After 60 days, the project is considered ended and the client pays for the work done under clause 10.

5. Client responsibilities

Providing accurate content, making sure they have the right to use any photos or text they send, and holding the licenses their travel business needs for the programs and prices they offer.

6. Ownership

• Yours: the site's content and structure (text, photos, programs, data and page layout), the domain registered in your name, and a copy of the site on your own account from launch day.
• XAVIX's: the source code and the tools, unless the contract says otherwise.
• You may move your work to another company that edits and develops your site. That company may not use, reproduce, sell or reuse the source code in other projects.

7. Domain and hosting

The domain is registered in the client's name and the client pays its renewal. Hosting is included for the first year, then included in any monthly plan, or paid by the client directly to the hosting provider.

8. Warranty

30 days after launch to fix any defect in what was delivered, at no cost. The warranty doesn't cover new additions, or any change made to the site by someone else.

9. Results

We build sites ready for search engines, but we don't guarantee a specific Google ranking, visibility in AI tools, or a specific number of requests or bookings.

10. Ending the contract and refunds

When the relationship ends, the client receives all their content and the site stays live for a 30-day transition period; payment for work already done remains due. The 50% deposit is non-refundable once the requirements document is signed and work has started; before that, it's refunded minus the hours of the requirements sessions. If a project is cancelled mid-way, the client pays for the hours actually worked at the hourly rate, and never less than the deposit.

11. Governing law

These terms and the contracts based on them are governed by Egyptian law, and the Egyptian courts have jurisdiction over any dispute. If the business moves to another country, a new version of these terms will be issued, and contracts signed before it stay under the version they were signed under.
